Who can claim for a personal injury or accident?

Anyone can make a claim for a personal injury. However, if you’re under the age of 18 then the Courts will look to appoint what is known as a ‘litigation friend’ to manage the claim on that person’s behalf. This is usually either a parent, carer or another family member.

General damages relate to the injury itself so can be quite difficult to quantify, since no two cases are ever the same. That said, we do base our settlement figures on an official publication which is widely recognised by the Courts known as ‘Guidelines for the Assessment of General Damages in Personal Injury Cases’. This publication provides us with general guidance which we’ll often refer to when negotiating with the other party, or parties.


In addition to general damages, you might also be able to claim ‘special damages’. These tend to be much easier to quantify since they relate to specific expenses you might incur as a result of your accident or injury such as prescription charges, travel expenses, loss of earnings and so on.
